{"id":2247,"date":"2021-12-20T12:22:16","date_gmt":"2021-12-20T11:22:16","guid":{"rendered":"http:\/\/www.balkan-conflicts-research.com\/archive\/?page_id=2247"},"modified":"2021-12-20T12:22:16","modified_gmt":"2021-12-20T11:22:16","slug":"yugoslavia-takes-nato-to-court-by-mike-corder-29-april-1999","status":"publish","type":"page","link":"https:\/\/www.balkan-conflicts-research.com\/archive\/yugoslavia-takes-nato-to-court-by-mike-corder-29-april-1999\/","title":{"rendered":"Yugoslavia Takes NATO to Court by Mike Corder, 29 April 1999"},"content":{"rendered":"<p><strong>Yugoslavia Takes NATO to Court<\/strong><\/p>\n<p><span class=\"Apple-converted-space\">\u00a0\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span>By MIKE CORDER Associated Press Writer<\/p>\n<p><span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>29 April 1999<\/p>\n<p>THE HAGUE, Netherlands (AP) &#8212; Yugoslavia\u00a0opened a new front in the Kosovo campaign\u00a0Thursday, filing World Court cases against 10\u00a0NATO allies in a legal bid to end the airstrikes<span class=\"Apple-converted-space\">\u00a0<\/span>it contends violate international law.<\/p>\n<p>Yugoslavia asked the 15-judge court, the United\u00a0Nations&#8217; highest judicial body, to rule that the\u00a036-day-old bombing campaign breaches\u00a0international law and to order an immediate halt\u00a0to NATO&#8217;s campaign while the case is being\u00a0considered &#8212; a process which can take years.<\/p>\n<p>But an international law expert described\u00a0Belgrade&#8217;s unprecedented action as a publicity<span class=\"Apple-converted-space\">\u00a0<\/span>stunt with little chance of success.\u00a0Terry Gill, who teaches international law at\u00a0Utrecht University in the Netherlands, predicted\u00a0the case &#8220;will not get past first base.&#8221;<\/p>\n<p>The United States, France and Germany all\u00a0have said they do not recognize the court&#8217;s<span class=\"Apple-converted-space\">\u00a0<\/span>jurisdiction unless it is identified as the forum\u00a0for solving disputes arising from a specific\u00a0treaty.<\/p>\n<p><span class=\"Apple-converted-space\">\u00a0<\/span>&#8220;The reason Yugoslavia is doing this is\u00a0obviously to apply diplomatic pressure and\u00a0sow dissension in NATO,&#8221; Gill said. &#8220;There is<span class=\"Apple-converted-space\">\u00a0<\/span>some doubt among NATO states about the\u00a0legality of what they are doing, so something\u00a0like this could cause embarrassment.&#8221;<\/p>\n<p>An emergency hearing was likely to be\u00a0scheduled next week to discuss Belgrade&#8217;s\u00a0request for the court to order a halt to the\u00a0airstrikes.<\/p>\n<p>Three Yugoslav officials filed papers with\u00a0court officials early Thursday. All were\u00a0wearing the lapel pins depicting a target &#8212; what\u00a0has become the symbol of Serb defiance to\u00a0NATO airstrikes.<\/p>\n<p>Neither the court nor Yugoslav officials would<span class=\"Apple-converted-space\">\u00a0<\/span>say which allies were named in the action, but<span class=\"Apple-converted-space\">\u00a0<\/span>an U.S. Embassy official speaking on condition\u00a0of anonymity said the United States was one of<span class=\"Apple-converted-space\">\u00a0<\/span>the 10.<\/p>\n<p>The World Court, which has no enforcement<span class=\"Apple-converted-space\">\u00a0<\/span>powers and relies on states to comply\u00a0voluntarily with its rulings, declined to\u00a0comment on the case, the first time a state has<span class=\"Apple-converted-space\">\u00a0<\/span>filed simultaneous cases against 10 other\u00a0countries at the court.<span class=\"Apple-converted-space\">\u00a0<\/span>NATO&#8217;s airstrikes are aimed at stopping\u00a0Belgrade&#8217;s crackdown on ethnic Albanians in Kosovo.<\/p>\n<p>Gill said even if the court were to order a halt to airstrikes, Yugoslavia would have to seek a U.N. Security Council resolution ordering compliance if the NATO allies refused to stop their bombing.<\/p>\n<p>But that move is &#8220;not an option,&#8221; Gill said, because the United States, Britain and France are all permanent council members.<\/p>\n<p>&#8220;This is just a public relations stunt,&#8221;
