{"id":1903,"date":"2021-01-11T12:07:08","date_gmt":"2021-01-11T11:07:08","guid":{"rendered":"http:\/\/www.balkan-conflicts-research.com\/archive\/?page_id=1903"},"modified":"2021-01-11T21:35:30","modified_gmt":"2021-01-11T20:35:30","slug":"trial-appellate-chamber-rotation-at-icty","status":"publish","type":"page","link":"https:\/\/www.balkan-conflicts-research.com\/archive\/trial-appellate-chamber-rotation-at-icty\/","title":{"rendered":"Trial\/Appellate chamber rotation at ICTY"},"content":{"rendered":"<p><strong>Trial\/Appellate chamber rotation at ICTY<\/strong><\/p>\n<p>The Srebrenica Historical Project has recently highlighted another area where the practice of The Hague Tribunal has been highly questionable &#8211; the fact that Hague trial and appeal panels are drawn from the same pool.<\/p>\n<p>This means that every ICTY judge will serve as a trial judge in some cases and an appellate judge on others.<span class=\"Apple-converted-space\">\u00a0 <\/span>This breaks the universally accepted principle that there should be complete separation between trial and appellate judges.<\/p>\n<p>Two legal experts generally supportive of the ICTY, Professor Michael Scarf and Professor William Schabas, both expressed their dismay. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Scharf noted that UN general-Secretary Boutros Boutros Ghali had insisted on the separation of the trial and appellate chambers, but had been ignored.<span class=\"Apple-converted-space\">\u00a0 <\/span>The adoption of the rotation rules \u201cis not the kind of decision one would expect from a Tribunal keenly aware of the need to be perceived as above reproach\u201d, he wrote.<\/p>\n<p>Schabas shared this concern and emphasised the practical advantages of separation: \u201c\u201cThis would ensure a clear distinction between the two functions, effectively eliminate the possibility of a \u2018contaminated\u2019 judge sitting on an appeal, and probably help to reduce the potential for tensions among the judges themselves.
