This announcement by\u00a0The Hague Tribunal on 24 February 2004 provides interesting insight into the petty machinations of an illegal court.<\/i><\/strong><\/p>\n

Of particular amusement is the reference in paragraph 4 concerning “the use by detainees\u00a0<\/span>in the\u00a0Tribunal’s Detention Unit of their communications privileges for\u00a0<\/span>purposes\u00a0likely to frustrate the Tribunal’s mandate to assist in the\u00a0<\/span>restoration and\u00a0maintenance of peace in the former Yugoslavia”. \u00a0<\/span><\/strong><\/em><\/p>\n

EXTENSION OF COMMUNICATION RESTRICTIONS ON VOJISLAV SESELJ AND SLOBODAN\u00a0MILOSEVIC\u00a0<\/span><\/p>\n

Contacts with their immediate family are authorized under conditions\u00a0<\/span>and\u00a0Milosevic’s needs to prepare his defence are taken into account.<\/span><\/p>\n

On 6 February 2004, the Tribunal’s Deputy Registrar, David Tolbert,\u00a0<\/span>issued\u00a0two further Decisions, concerning the communication privileges of\u00a0<\/span>Vojislav\u00a0Seselj and Slobodan Milosevic.\u00a0<\/span><\/p>\n

The Decisions were filed on 9 February and served on both Accused on\u00a0<\/span>the same\u00a0day.<\/span><\/p>\n

These Decisions are subsequent to Decisions issued on 11 December 2003\u00a0<\/span>and on\u00a09 January 2004 by the Deputy Registrar concerning the use by detainees\u00a0<\/span>in the\u00a0Tribunal’s Detention Unit of their communications privileges for\u00a0<\/span>purposes\u00a0likely to frustrate the Tribunal’s mandate to assist in the\u00a0<\/span>restoration and\u00a0maintenance of peace in the former Yugoslavia (see Press Releases\u00a0<\/span>810e and 814e).<\/span><\/p>\n

Vojislav Seselj:<\/span><\/p>\n

Considering that the Accused’s defiant position is unchanged and\u00a0<\/span>continues\u00a0to be of concern, the Deputy Registrar decided to Prohibit,\u00a0<\/span>unless\u00a0otherwise authorized by the Commanding Officer of the Detention Unit,\u00a0<\/span>all\u00a0communication between the Accused with person(s) except for his legal\u00a0<\/span>counsel (if\u00a0applicable), diplomatic or consular representatives and his immediate\u00a0<\/span>family, provided\u00a0that his contact with his family shall be subject to live monitoring\u00a0<\/span>under\u00a0conditions prescribed by the Commanding Officer of the Detention\u00a0<\/span>Unit.<\/span><\/p>\n

Slobodan Milosevic:<\/span><\/p>\n

Considering that the Accused has complied with the Decision of 9\u00a0<\/span>January and\u00a0that he needs to take steps to prepare his defence case, the\u00a0<\/span>Deputy\u00a0Registrar ordered that:<\/span><\/p>\n

– telephone communications from and to Slobodan Milosevic be restricted\u00a0<\/span>to\u00a0legal counsel, diplomatic or consular representatives and his immediate\u00a0<\/span>family\u00a0(provided that this last type of conversations be monitored);<\/span><\/p>\n

– visits to Slobodan Milosevic be restricted to legal counsel,\u00a0<\/span>diplomatic or\u00a0consular representatives and his immediate family, save other visits\u00a0<\/span>authorized by the Commanding Officer of the Detention Unit;<\/span><\/p>\n

– these restrictions will not apply to communication and visits\u00a0<\/span>which are\u00a0reasonably necessary for the preparation of the Accused’s defence,\u00a0<\/span>including\u00a0interviewing by telephone or in person potential witnesses or otherwise\u00a0<\/span>collecting evidence in his defence, provided that this facility shall\u00a0not be used in\u00a0<\/span>any manner for any contacts with the media.<\/span><\/p>\n

The Deputy Registrar’s Decisions (Milosevic|Seselj) (available in\u00a0<\/span>full in\u00a0English and BCS on the Tribunal’s website and from the Press Unit)\u00a0<\/span>will apply for\u00a0a period of thirty (30) days from 10 February 2004.<\/span><\/p>\n
