This interesting exchange came in the BBC Radio Documentary <\/i>“The Final Judgement: Searching for International Justice<\/i>\u201d<\/i>\u00a0\u00a0<\/i>September 9, 2003. \u00a0The BBC<\/i>\u2019<\/i><\/span>s Edward Stourton was talking to Richard Goldstone, the ICTY<\/i>\u2019<\/i><\/span>s first Chief Prosecutor about\u00a0<\/i>The Hague<\/i><\/span>\u00a0Tribunal (ICTY). \u00a0It suggests that Goldstone was well aware that the ICTY had been created on a very fragile legal basis.<\/i><\/b><\/span><\/div>\n

EDWARD STOURTON: It’s interesting, you said, that the court was \u2026 the courts were\u00a0established under chapter 7 of the United Nations Charter which is\u00a0<\/span>really\u00a0about peace and security not about justice – that was \u2026 was that sort\u00a0of creative law making – making a link between the idea of justice and\u00a0<\/span>the\u00a0idea of peace and security that was established at the time that the\u00a0<\/span>Yugoslavia and Rwanda courts were set up?<\/span><\/p>\n
